COMPANY ORGANISING THE PROMOTION
The Company CIFRE CERAMICA SOCIEDAD LIMITADA with registered address at Ctra. Vila-real-Onda, Km. 10 12200 Onda, Castellón (Spain) Apdo. 350 – 12540 Vila-real and identified with the number B12284634 organises the prize draw (hereinafter, “the Promotion”) of national scope, to be developed through the Instagram social network at international level, in accordance with the provisions of the participation requirements section.
The purpose of this prize draw is to PRIZE the visit of our followers to our Stand at Cersaie 2023, in Bologna, Italy.
START DATE AND END DATE
Participation in the promotion is open from the start of Cersaie 2023 on 25 September 2023 until the end of the promotion on 29 September at 23:59h.
The winner will be chosen by draw (in detail in section 5. Conditions of the promotion and prizes) and will be announced on Monday 2 October 2023.
The Company reserves the right not to proceed with the promotional action if no participation is registered by the promotional dates.
PARTICIPANT REQUIREMENTS
MECHANICS OF THE PROMOTION
A post with the draw will be published on the official Instagram account of Cifre Cerámica (@cifreceramica). To participate and to be considered valid:
TERMS AND CONDITIONS OF THE PROMOTION AND PRIZES
The prize will be publicly notified on Monday 2 October 2023 on Cifre’s official Instagram account, once it has been verified that the winner has complied with all the pre-established rules.
The Promotion will have a single winner. The winner will be decided by means of a draw with the Instagram user names of the valid participants through the AppSorteos website, in the category Draw by Random Names (https://app-sorteos.com/es/apps/sorteados). The procedure will be recorded and published in the post to announce the winner in order to demonstrate compliance with these rules.
That person will receive an iPad [iPad 9th Generation, 64GB, Wi-Fi] as a prize.
The winner will be able to contact Cifre Cerámica via Instagram within 72 hours from the date on which it is announced on the brand’s social profile. If no such contact is made within the stipulated period, the other winner will be declared via a draw from among those who took part. If no response is received after this second draw, the Promotion will be declared void.
The prize cannot be exchanged for cash or any other prize, nor can it be subject to change or alteration. The Company reserves the right to modify the prize if, on the day of declaring the participant as the winner, there are problems of stock of the prize or any other inconvenience and, therefore, it is impossible to give the prize. Any other additional expenses, unrelated to the concepts included in the prize, related to the prize or its enjoyment, will be borne by the winner.
The use and enjoyment of the prize is reserved to the winner. Under no circumstances may the prize holder transfer or exchange the prize with any other person/s.
The holding of the draw and the awarding of the prize are subject to the tax regulations in force.
DISQUALIFICATIONS AND PENALTIES
If it becomes evident that any of the Participants do not comply with the requirements demanded in the Bases, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded by virtue of this Promotion. The Company reserves the right to declare the draw void.
PUBLICATION OF COMMENTS OR OPINIONS IN THE STORIES
Stories whose content is deemed inappropriate, offensive, abusive or discriminatory or which may infringe the rights of third parties will not be permitted. Nor will we allow Stories against a private individual that violate the principles of the right to honour, to personal and family privacy and to one’s own image.
We shall not be held responsible for any damage caused by the Stories made by Participants in the Promotion, which may at any time offend the sensibilities of other Participants.
Participation in this Promotion, as well as the publication of the Stories made by the Participants, may not violate the Instagram Community Rules or the Instagram Terms of Use under any circumstances. If the Company is found to have used fraudulent means to participate, the prize will not be awarded and will remain the property of the Company.
PERMISSION TO USE NAME AND MATERIALS
Participants in the sweepstakes authorise the public use of their Instagram username for the purpose of communicating their winning conditions. In order to manage the delivery of the prize, we will also ask for the necessary data for the delivery: name / surname / address / postcode / city.
The Company responsible for the treatment of your data is BJORDAN MARKETING ONLINE, S.L, with address in C/ Mayor 82, esc 7, pta 21, 12001, Castellón (Spain) and identification number B67920264, as well as Cifre Cerámica.
In accordance with the provisions of the General Data Protection Regulation, by accepting these Legal Bases, each participant consents to their personal data being included in a file, owned by Cifre Cerámica, for the purpose of managing the prize draw, as well as disseminating and publicising its results, and processing the delivery of the prize.
We inform you that you can exercise your rights of access, rectification, deletion, opposition, limitation of processing, portability, oblivion and not to be subject to automated individual decisions by sending an e-mail to contacto@cifreceramica.com or by letter to the following address: Ctra. Vila-real-Onda, Km. 10 12200 Onda, Castellón (Spain), Apdo. 350 – 12540 Vila-real, enclosing in both cases a copy of an identification document.
Without prejudice to any other administrative or judicial remedy, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in the event that he/she considers that the processing of his/her personal data is not lawful, as well as in the event that he/she is not satisfied with the exercise of his/her rights.
The Participant therefore declares that he/she has been informed of the conditions on personal data protection and accepts and consents to the processing.
EXEMPTION FROM LIABILITY
Both Cifre and the company managing the prize draw shall not be held responsible for any possible losses, theft, delays or any other circumstance attributable to third parties that
may affect the development of this Promotion and the delivery of the prize, nor are we responsible for the use made by the Participant of his/her prize.
We do not assume responsibility in cases of force majeure or unforeseen circumstances that may prevent the Promotion from taking place or the total or partial enjoyment of the prize.
In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under the control of Cifre Cerámica and that affects the normal development of the Promotion, we reserve the right to cancel, modify or suspend the same, including the participation web page.
CHANGES AND ACCEPTANCE
We reserve the right to modify or extend these promotional rules, insofar as this does not prejudice or undermine the rights of the Participants in the Promotion. Changes will be reported on Cifre Cerámica’s Instagram profile.
The mere fact of participating in the draw implies that the Participant fully accepts the conditions of these Legal Bases. Likewise, participation in a prize draw of this nature implies acceptance of the rules of the Instagram social network through which the prize draw takes place.

APPLICABLE LEGISLATION AND JURISDICTION
These legal bases will be governed in accordance with the law of Spain. The Courts and Tribunals of the city of residence of the Participant will be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or fulfilment of these rules.
